Welcome to Artist Launcher — The Independent Music Discovery Ecosystem.

These Terms of Service (“Terms”) govern your access to and use of the Artist Launcher platform, website, applications, products, services and related tools (collectively, the “Platform”).

By creating an account, accessing or using Artist Launcher, you acknowledge that you have read, understood and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all users of Artist Launcher, including but not limited to:

• Artists and bands
• Rights holders
• Playlist curators
• Community and campus radio stations
• Commercial radio stations
• Individual radio programmers and shows
• Festivals and venues
• Bloggers and journalists
• Record labels and publishers
• Service providers
• Music organisations
• Other approved participants within the Artist Launcher ecosystem

Artist Launcher may introduce new products, services or features from time to time. Unless otherwise stated, those services will also be governed by these Terms together with any applicable service-specific agreement.

1. About Artist Launcher

Artist Launcher is an independent music discovery ecosystem designed to help artists and music industry participants discover opportunities, build professional relationships and promote original creative work.

Depending on the services available, Artist Launcher may provide tools and opportunities including, but not limited to:

• Artist profiles
• Track Pages
• Public Pages
• Music submissions to playlist curators
• Music submissions to community and commercial radio stations
• Music submissions to other approved industry participants
• Curator reviews and feedback
• Industry opportunities
• Promotional and marketing tools
• Artist resources
• AI-assisted metadata generation and workflow tools
• Future products and services supporting the independent music community

Artist Launcher acts as a facilitator that helps connect participants within the ecosystem.

Unless expressly stated otherwise, Artist Launcher does not act as:

• an artist manager
• a booking agent
• a music publisher
• a record label
• a broadcaster
• an employer
• a legal representative
• an agent for any participant

Any relationship or agreement entered into between participants remains solely between those participants unless Artist Launcher expressly states otherwise.

2. Additional agreements

Certain Artist Launcher services are governed by additional agreements, policies or guidelines. By using those services you also agree to comply with the applicable documents, which form part of these Terms. These are:

• the Privacy Policy
• the Track Page Agreement
• the Pages Participation Agreement
• the Services & Transactions Agreement
• the Community & Content Guidelines
• the Verification & Trust Policy

Where there is any inconsistency between these Terms and a service-specific agreement, the service-specific agreement applies, and only to the relevant service.

3. Eligibility

To use Artist Launcher you must be at least 18 years of age, or have the consent of a parent or legal guardian where permitted by applicable law.

By creating an account or using the Platform, you represent and warrant that:

• the information you provide is accurate, complete and truthful
• you have the legal capacity to enter into these Terms
• you have the authority to upload, publish, submit or otherwise share any content you make available through the Platform
• your use of the Platform complies with all applicable laws and regulations
• you will keep your account information reasonably current

Artist Launcher reserves the right to suspend or terminate accounts that provide false, misleading or fraudulent information.

4. Account registration & security

Certain Artist Launcher services require you to create an account. You agree to:

• maintain the confidentiality of your login credentials
• be responsible for all activity conducted under your account
• notify Artist Launcher immediately if you become aware of any unauthorised access or security breach
• provide accurate registration information
• promptly update your information where it changes

You are responsible for maintaining the security of your account. Artist Launcher is not responsible for any loss resulting from your failure to protect your account credentials.

Artist Launcher reserves the right to suspend, restrict or terminate accounts that violate these Terms or otherwise threaten the integrity, safety or security of the Platform.

5. Platform services

Artist Launcher provides tools and opportunities that help participants discover, promote, connect and collaborate within the independent music community.

Artist services

Artists and rights holders may be able to:

• create artist profiles
• create and manage Track Pages
• upload music, artwork, media kits, videos and other approved content
• submit music to playlist curators, radio stations and other approved industry participants
• receive reviews, feedback and other responses
• promote releases, services and professional activities
• participate in future Artist Launcher programmes and initiatives

Industry Pages

Approved organisations and industry participants may create public Pages to showcase their organisation, services or opportunities — including radio stations and shows, festivals, venues, blogs, publications, labels, publishers, music organisations, educational institutions, producers, studios, merchandise providers and other approved participants.

Creating a Page does not imply endorsement, recommendation or verification by Artist Launcher. Separate agreements apply to Pages that offer commercial products or services through the Platform.

Future services

Artist Launcher may introduce additional products, services or features from time to time, and reserves the right to modify, suspend or discontinue any feature or service at any time, with or without notice, where reasonably necessary for operational, legal or business purposes. The introduction or removal of any service does not create an obligation to continue offering that service indefinitely.

6. Independent editorial & professional decisions

Artist Launcher is committed to supporting a fair, transparent and independent music discovery ecosystem. Editorial, programming, professional and commercial decisions remain solely with the individual participant or organisation receiving a submission or opportunity.

Artist Launcher does not direct, influence or guarantee decisions relating to:

• playlist inclusion
• radio airplay
• interviews, reviews and editorial coverage
• festival selection and event bookings
• licensing opportunities
• commercial agreements and partnerships
• service provider selection
• any other opportunity available through the Platform

Payment of platform fees, subscription fees or other charges to Artist Launcher does not influence or guarantee any editorial, programming or professional decision made by another participant. All participants remain solely responsible for their own independent decisions.

7. Results disclaimer

Artist Launcher provides tools and opportunities intended to support artists and music industry participants. While we strive to facilitate meaningful discovery and professional connections, we do not guarantee any specific outcome from using the Platform. This includes, but is not limited to, playlist placement, radio airplay, media coverage, interviews, festival acceptance, bookings, collaborations, record deals, publishing agreements, licensing opportunities, audience growth, followers or subscribers, streaming performance, chart positions or revenue.

Success depends upon many factors outside the control of Artist Launcher, including the quality of creative work, participant preferences, market conditions, audience interests and third-party platforms. Each opportunity remains subject to the independent assessment of the receiving participant.

8. User responsibilities

Every participant contributes to the quality and integrity of the ecosystem. By using the Platform, you agree to:

• provide accurate, complete and truthful information
• maintain your account information and public profile
• keep Track Pages and public Pages reasonably up to date
• upload only content that you own or are legally authorised to use
• comply with all applicable laws and regulations
• conduct yourself professionally and respectfully
• respect the intellectual property rights of others
• comply with Artist Launcher policies and service-specific agreements
• respond honestly to any verification request made by Artist Launcher

Where Artist Launcher requests additional information to verify an individual, organisation, Page, Track Page or other content, you agree to provide accurate information within a reasonable time. You remain solely responsible for all information, content and activities associated with your account.

9. Trust & verification

Maintaining trust within the ecosystem is fundamental to our mission. Artist Launcher may establish verification programmes for individuals, organisations, Pages, Track Pages or other participants. Verification may include review of identity, business registration, ownership of an organisation, websites or social media, industry affiliations, supporting documentation or other information reasonably required.

Verification indicates only that Artist Launcher has reviewed certain information provided by the participant. Verification:

• does not constitute an endorsement
• does not guarantee quality
• does not guarantee legitimacy beyond the information reviewed
• does not create any partnership or agency relationship

Artist Launcher may approve or decline verification requests, request additional information, suspend or revoke verification, remove verification badges, or refuse verification where necessary to protect the integrity of the Platform. The full process is set out in the Verification & Trust Policy.

10. Platform integrity

Participants must not:

• create fake or duplicate accounts
• impersonate another individual or organisation
• provide false, misleading or fraudulent information
• manipulate submissions, reviews, ratings or engagement
• artificially inflate streams, followers or other performance metrics
• submit spam or unsolicited mass submissions
• misuse automated systems or bots
• upload malicious software or harmful code
• infringe the intellectual property rights of others
• harass, threaten or abuse other participants
• attempt to circumvent Artist Launcher policies or verification processes
• interfere with the operation, security or integrity of the Platform

Artist Launcher may establish submission limits, matching requirements, verification requirements, quality controls and other operational standards designed to maintain the quality of the ecosystem, and may suspend, restrict or terminate accounts, remove Track Pages, Pages or other content, revoke verification, or otherwise limit access where reasonably necessary to protect participants and partner organisations, maintain platform integrity, prevent fraud or abuse, comply with legal obligations, or preserve the safety, quality, trust and reputation of the ecosystem.

Repeated or serious violations may result in permanent removal from the Platform.

11. Music ownership & submission rights

Participants remain solely responsible for ensuring that they have all necessary rights, licences, permissions and authority to upload, publish, submit or otherwise make content available through Artist Launcher.

By submitting any content through the Platform, you represent and warrant that:

• you own or control all necessary rights required to use and submit the content
• your content does not knowingly infringe the intellectual property or other rights of any third party
• you have obtained any required permissions relating to samples, cover songs, recordings or other third-party material
• the information you provide is accurate and complete to the best of your knowledge
• your submissions comply with applicable laws and regulations

Artist Launcher may rely on the information provided by participants when facilitating submissions and opportunities. Detailed rights, licences, permissions and declarations relating to uploaded music are governed by the Track Page Agreement, which forms part of these Terms where applicable.

12. Intellectual property

Artist Launcher and its licensors retain all intellectual property rights relating to the Platform, including software, branding, logos, trademarks, graphics, website design, documentation, proprietary technology and other platform content. Nothing in these Terms transfers ownership of Artist Launcher intellectual property to any participant.

Participants retain ownership of their own original content, subject to any licences granted under the applicable Track Page Agreement or other service-specific agreement. Participants may not copy, reproduce, modify, distribute or commercially exploit Artist Launcher intellectual property without prior written permission.

13. Community standards

Artist Launcher is committed to fostering a respectful, inclusive and professional community. All participants are expected to interact with others in a respectful and constructive manner, and must not engage in conduct that is abusive, threatening or discriminatory, promotes illegal activity, harasses or intimidates others, deliberately misleads other participants, damages the reputation of the Platform or its participants, or interferes with the safe and professional operation of the ecosystem.

Detailed behavioural expectations are set out in the Community & Content Guidelines, which form part of these Terms.

14. Payments

Certain Artist Launcher services may require payment of fees. Where applicable:

• all fees will be clearly disclosed before purchase
• payments are processed through approved third-party payment providers
• participants are responsible for any applicable taxes unless otherwise stated
• fees relate to access to Artist Launcher services and do not guarantee editorial outcomes or commercial success

Artist Launcher reserves the right to introduce, modify or discontinue pricing, subscription plans or service fees at any time. Changes will not affect purchases already completed unless required by law or agreed otherwise.

15. Chargebacks & payment disputes

If you initiate a chargeback or payment dispute without first contacting Artist Launcher to resolve the matter, Artist Launcher reserves the right to suspend your account, restrict access to paid services, recover any reasonable costs incurred, or terminate your account where appropriate.

Nothing in this section limits your legal rights under applicable consumer protection laws.

16. Services & transactions

Artist Launcher may, now or in the future, facilitate commercial interactions between participants, including services, products or other business opportunities. Where Artist Launcher facilitates such transactions, the additional terms in the Services & Transactions Agreement apply.

Unless expressly stated otherwise:

• Artist Launcher is not a party to agreements entered into between participants
• participants remain responsible for negotiating, performing and fulfilling their own agreements
• Artist Launcher does not guarantee the quality, performance or outcome of services provided by participants

Where Artist Launcher collects commissions or transaction fees, those fees will be disclosed before completion of the transaction.

17. Third-party platforms & services

Artist Launcher integrates with, or may provide access to, third-party platforms and services including Spotify, Apple Music, YouTube, Stripe, Discord, radio stations, social media platforms and other approved third-party providers. By connecting or using those services through Artist Launcher, you also agree to comply with their applicable terms and conditions.

These services operate independently of Artist Launcher and remain subject to their own terms, conditions and privacy policies. Artist Launcher is not responsible for the availability, accuracy, policies or actions of third-party services or organisations. Participants use third-party services at their own risk.

18. Artificial intelligence

Artist Launcher may use artificial intelligence and automated technologies to assist in providing certain Platform features and services, including metadata extraction, content classification, submission preparation, search and discovery, recommendations, workflow automation and other platform improvements.

Participants remain solely responsible for reviewing and confirming the accuracy of all information submitted through the Platform. Where participants disclose the use of AI in creating or promoting content, they are responsible for ensuring that such disclosures are accurate. Artist Launcher does not verify the accuracy of AI-related declarations unless expressly stated otherwise.

AI technologies are intended to assist platform functionality and do not replace independent human judgement by participants or organisations.

19. Suspension & termination

Artist Launcher reserves the right to suspend, restrict or terminate your account, remove content, revoke verification or limit access to any part of the Platform where reasonably necessary to enforce these Terms or any applicable agreement, protect the safety, integrity or reputation of the Platform, protect artists, organisations or other participants, investigate suspected fraud, abuse or unlawful activity, comply with legal or regulatory obligations, or protect Artist Launcher or its partners from legal or commercial risk.

Where appropriate, Artist Launcher may provide notice of suspension or termination. However, Artist Launcher reserves the right to take immediate action where necessary to protect the Platform or its participants. Termination of an account does not release any participant from obligations incurred before termination.

20. Limitation of liability

To the fullest extent permitted by applicable law, Artist Launcher, its directors, officers, employees, contractors, affiliates and partners shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising from or relating to use of the Platform, inability to access the Platform, submissions made through the Platform, decisions made by independent participants, third-party services, interruptions or technical failures, loss of profits, loss of business opportunities, loss of reputation, loss of data, or other consequential losses.

Artist Launcher provides the Platform on an “as available” and “as is” basis.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

21. Indemnification

You agree to indemnify, defend and hold harmless Artist Launcher, its directors, officers, employees, contractors and affiliates from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms or any applicable Artist Launcher agreement, your infringement of any third-party rights, your misuse of the Platform, content you upload, publish or submit, or any unlawful or negligent act or omission by you.

This obligation survives termination of your account.

22. Changes to these Terms

Artist Launcher may update these Terms from time to time to reflect changes in our services, legal requirements, technology, business operations or industry practices. When material changes are made, the “Last updated” date at the top of these Terms will be revised, and where required by law Artist Launcher will provide reasonable notice of significant changes.

Your continued use of the Platform after updated Terms become effective constitutes your acceptance of those revised Terms.

23. Governing law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada. Any dispute arising out of or relating to these Terms or your use of Artist Launcher shall be subject to the exclusive jurisdiction of the courts of British Columbia, unless otherwise required by applicable law.

Nothing in these Terms limits any mandatory consumer protection rights that may apply under the laws of your jurisdiction.
