Welcome to Artist Launcher. These Terms and Conditions ("Terms") govern your access to and use of the Artist Launcher platform, website, services, and related tools (collectively, the "Platform").

By accessing or using Artist Launcher, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

Scope of Terms

These Terms primarily apply to Artist Launcher's music submission, review, and curator feedback services. Additional services provided by Artist Launcher may be subject to separate service-specific terms.

1. About Artist Launcher

Artist Launcher is a music services platform that provides tools and opportunities designed to help music artists discover, promote, and grow their audiences. The platform may offer a variety of services including, but not limited to:

  • music discovery opportunities
  • music review and feedback services
  • playlist consideration
  • promotional tools
  • educational resources
  • marketing and audience growth services

These Terms and Conditions govern the use of Artist Launcher's music review and curator feedback services (the "Review Services").

Additional services offered by Artist Launcher may be governed by separate terms, guidelines, or service agreements, which will be presented to users where applicable.

2. Eligibility

To use Artist Launcher you must:

  • be at least 18 years of age, or
  • have the consent of a legal guardian.

By using the Platform you confirm that:

  • all information provided is accurate and truthful
  • you have the legal right to submit any music uploaded or shared through the Platform.

3. Account Registration

Users must create an account to access certain services. You agree to:

  • maintain the confidentiality of your account credentials
  • be responsible for all activity conducted through your account
  • provide accurate and up-to-date information.

Artist Launcher reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Platform Services

Artist Launcher provides a feature that allows Artists to submit music to Curators for review, feedback, and potential playlist consideration (the "Review Services").

Through the Review Services:

Artists may:

  • submit music tracks for review
  • receive feedback from Curators
  • have their music considered for potential playlist inclusion.

Curators may:

  • review submitted tracks
  • provide written feedback
  • independently determine whether a track fits their playlist.

Artist Launcher acts solely as a facilitator of submissions and feedback between Artists and independent Curators. The Platform does not control the editorial decisions of Curators.

5. Playlist Placement Disclaimer

Artist Launcher does not sell, guarantee, or otherwise offer playlist placement on any streaming platform.

Artists pay for the opportunity to have their music reviewed by independent Curators. Curators are compensated for the time and effort involved in reviewing submissions and providing feedback.

Any decision by a Curator to add a track to a playlist is made independently and voluntarily and is not influenced by payment.

Payment to Artist Launcher does not guarantee:

  • playlist placement
  • streams
  • followers
  • engagement
  • exposure
  • or any specific outcome.

6. Results and Promotion Disclaimer

Artist Launcher may offer various tools, services, and opportunities intended to assist artists in promoting their music, discovering audiences, and connecting with industry professionals.

While these services are designed to support artist growth, Artist Launcher does not guarantee any specific results from the use of the Platform or its services. This includes, but is not limited to, guarantees of:

  • playlist placements
  • streams
  • followers or subscribers
  • chart positions
  • audience growth
  • revenue or financial return
  • exposure or career advancement.

Any success achieved by an Artist through the use of the Platform depends on numerous factors outside the control of Artist Launcher, including but not limited to the quality of the music, audience preferences, market conditions, and third-party platform algorithms.

By using Artist Launcher, users acknowledge that all promotional opportunities are provided on a best-efforts basis and outcomes cannot be guaranteed.

7. Independent Curator Decision-Making

Curators retain full editorial independence when reviewing music submissions. Curators are not required or incentivized to add any track to their playlists. Compensation received through the Platform is solely for reviewing and providing feedback on submitted music.

8. Curator Responsibilities

Curators using the Platform agree to:

  • maintain authentic playlists
  • provide honest and constructive feedback when required
  • make decisions based on genuine editorial judgment.

Curators must not:

  • accept compensation outside the Platform for playlist placement
  • artificially inflate playlist followers or engagement
  • operate fake or misleading playlists.

Artist Launcher reserves the right to remove or suspend Curators who violate these standards.

9. Compliance With Streaming Platform Policies

Users agree not to use Artist Launcher to engage in any activity that violates the terms or policies of third-party streaming platforms, including Spotify, Apple Music, or other streaming services.

Prohibited activities include but are not limited to:

  • paying for guaranteed playlist placement
  • artificially inflating streams
  • purchasing fake followers
  • using bots or automated listening
  • manipulating playlist content in exchange for compensation.

Any user found to be engaging in such activity may have their account suspended or permanently terminated.

10. Platform Integrity

To maintain trust and fairness, users must not:

  • create fake accounts
  • manipulate submissions or feedback
  • submit fraudulent or misleading content
  • use automated systems or bots.

Artist Launcher reserves the right to remove content, suspend accounts, or block access if such activity is detected.

11. Payment Terms

Artists may purchase submission credits or services to send music to Curators for review. Payments made through the Platform cover:

  • submission processing
  • curator review time
  • feedback delivery.

Payments do not purchase playlist placement.

Unless otherwise stated:

  • all payments are non-refundable
  • unused credits may expire according to the platform's policies.

Artist Launcher reserves the right to modify pricing at any time.

12. Payment Disputes and Chargebacks

Users agree not to initiate unjustified payment disputes, chargebacks, or reversals for services that have already been delivered or accessed through the Platform.

A service is considered delivered when:

  • a submission has been successfully sent to Curators, or
  • credits have been issued to a user account, or
  • a service or feature has been activated.

If a user initiates a chargeback or payment dispute without first contacting Artist Launcher to resolve the issue, Artist Launcher reserves the right to:

  • suspend or terminate the user's account
  • revoke access to platform services
  • recover any fees, penalties, or administrative costs incurred as a result of the chargeback.

Artist Launcher also reserves the right to restrict future access to the Platform for users who abuse payment systems.

13. Curator Compensation

Curators participating in the Platform may receive compensation for reviewing submissions and providing structured feedback. Compensation is not tied to playlist placement and is provided regardless of whether a track is added to a playlist.

14. Intellectual Property

Artists retain full ownership of the music they submit. By submitting music through the Platform, Artists grant Artist Launcher a limited, non-exclusive license to:

  • deliver the music to Curators for review
  • display metadata and artwork within the Platform
  • facilitate feedback and playlist consideration.

Artist Launcher does not claim ownership of submitted music.

15. Music Ownership and Submission Rights

By submitting music to the Platform, the user represents and warrants that they:

  • own the rights to the music being submitted, or
  • have obtained all necessary permissions, licenses, or authorizations to submit the music for review and distribution to Curators.

Users must ensure that their submissions do not infringe upon the copyrights, trademarks, or other intellectual property rights of any third party.

Artist Launcher is not responsible for verifying ownership of submitted content. If Artist Launcher receives a valid complaint or notice that submitted content violates the rights of another party, Artist Launcher reserves the right to:

  • remove the content from the Platform
  • suspend or terminate the responsible account
  • cooperate with legal authorities where required.

Users agree to indemnify and hold Artist Launcher harmless from any claims arising from unauthorized or infringing submissions.

16. Third-Party Platform Disclaimer

Artist Launcher is an independent platform and is not affiliated with, endorsed by, or sponsored by any streaming service. Names and trademarks such as Spotify, Apple Music, and others belong to their respective owners.

17. Content Responsibility

Users are solely responsible for the content they submit, including:

  • music
  • artwork
  • metadata
  • links.

Users must ensure that submitted content does not infringe copyrights, trademarks, or other intellectual property rights. Artist Launcher reserves the right to remove any content that violates these Terms.

18. Suspension and Termination

Artist Launcher may suspend or terminate accounts that:

  • violate these Terms
  • engage in fraudulent activity
  • abuse other users
  • manipulate playlists or streams.

Termination may occur without prior notice where necessary to protect the Platform.

19. Limitation of Liability

Artist Launcher provides the Platform "as is" and "as available." To the fullest extent permitted by law, Artist Launcher shall not be liable for:

  • loss of revenue
  • loss of streaming performance
  • missed opportunities
  • indirect or consequential damages.

Artist Launcher does not guarantee the availability, reliability, or success of any submission.

20. Indemnification

Users agree to indemnify and hold harmless Artist Launcher and its affiliates from any claims, damages, or liabilities arising from:

  • misuse of the Platform
  • violation of these Terms
  • infringement of intellectual property rights.

21. Modifications to the Platform

Artist Launcher reserves the right to:

  • modify the Platform
  • add or remove features
  • change pricing or services.

We may update these Terms periodically. Continued use of the Platform constitutes acceptance of the updated Terms.

22. Governing Law & Jurisdiction

These Terms and any disputes arising out of or relating to the use of the Artist Launcher Platform shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

By using the Platform, you agree that any legal action, claim, or dispute arising out of or relating to these Terms or the use of the Platform shall be brought exclusively in the courts located in the Province of British Columbia, Canada, and you consent to the jurisdiction of such courts.

Spotify Platform Terms

The Platform integrates with the Spotify Platform to provide certain features. The following additional terms apply to your use of Spotify-related functionality:

Third-Party Beneficiary

Spotify AB is a third-party beneficiary of these Terms and is entitled to directly enforce any provision of these Terms that confers a benefit on or grants rights to Spotify. By using the Platform, you acknowledge and agree that Spotify AB may enforce these Terms against you as a third-party beneficiary.

Spotify Disclaimer of Warranties

Spotify provides its platform and content on an "as is" and "as available" basis. Spotify makes no warranties or representations, express or implied, regarding the Spotify Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Spotify Platform will be uninterrupted, error-free, or free of harmful components. Spotify shall not be liable for any damages arising from your use of the Platform or the Spotify Platform accessed through it.

Reverse Engineering Prohibition

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of any part of the Spotify Platform accessed through the Platform. This includes, but is not limited to, the Spotify Web API, Spotify authentication services, audio streaming protocols, and any Spotify content delivery mechanisms. Violation of this provision may result in immediate termination of your access and may subject you to legal action.
